Yakub Memon, a Mumbai based Chartered Accountant also awarded as the "Best CA of the year" for his CA firm. He was a well cultured and educated man but his involvement in one of the most inhuman activity putted him under the process of investigation and ultimately, execution.

After 1993 Mumbai Bomb Blasts, he was caught by the CBI at Delhi airport with some cassettes which contained the whole planning and execution of the bomb blasts. This made enough proof to arrest him. After Investigation, it was being found that the maximum amount of RDX was used in 1993 blasts after World War-2. Apart from this, a 1000 page charge sheet was presented in court.

CHARGES

Terrorist and Disruptive Activities (Prevention) Act (TADA Act) of 1985- Section 3 Clause (ii), (iii) (iv), section 5 and section 6.

This included allegations like involvement in the planning of bomb blasts and hiding weapons.

Indian Penal Code (IPC), 1860- Section 120 (b), 201, 212, 302, 307, 324, 326, 427, 435 and 436.

This included allegations like criminal conspiracy involvement, murder, attempt to murder, mischief by fire/explosive substance and causing disappearance of evidences.

Apart from this he was also charged under Explosive Substances Act, 1908; Arms Act, 1959; Prevention of Damage to Public Property Act, 1984 and Explosives Act,1884.

JUDGEMENT

Yakub Memon was awarded death sentence on 12 September, 2006. But then, on 28 January 2008, Supreme Court bench temporarily suspended his death sentence.  After this Supreme Court reserved its order over appeal on 29 August 2012. On 21 March 2013, SC maintained his death sentence and in May 2014, President of India rejected his mercy petition.

On 9 April 2015, honorable Sc dismissed review petition of death sentence upheld by TADA court. Further on 21 July 2015, a curative petition was rejected by SC. Memon then pleaded to SC seeking stay on his execution scheduled for 30 July 2015. A fresh mercy plea was presented to the Preseident of India on 29 July 2015, a day before his execution. On 30 July 2015, the fresh petition seeking stay on execution was rejected.

Finally, on 30 July 2015, Yakub Memon was hanged at the Nagpur Central Jail at 6.38 a.m.

According to Honorable Attorney General of India, "It is the end of a legal process and not a question of victory."

There were about 300 people, including 40 eminent ones who signed an application in support of Yakub Memon. One of the main grounds of support was optional protocol on international covenant of cultural and political rights. 

But we have seen the judgement and charges. Investigations proved and courts found him guilty. Also, our courts provided him enough time to prove his part.

Having faith in our Judiciary, we consider this execution to be necessary one providing justice to all the people who were killed and injured in the 1993, Mumbai bomb blasts.
